Welcome to the Ferrari webpage for anyone who wants to report an instance of Ferrari trademarks infringement.
The “Ferrari Anti-Counterfeiting Reward” Scheme (hereafter referred to as the “Scheme”) is designed to incentivise the identification of activities that infringe upon Ferrari S.p.A.’s trademarks. Rewards are offered to individuals who report potential trademark infringements. The Scheme is governed by the terms and conditions outlined in the rules on this page (hereafter referred to as the “Rules”). By submitting a report, each participant in the Scheme is deemed to have accepted these Rules.
Ferrari S.p.A. (hereinafter, “Ferrari”) with registered office in Modena (MO), Via Emilia Est 1163, VAT no. 00159560366.
The Scheme is intended for anyone who has identified a product potentially infringing on Ferrari’s trademarks being sold in a commercial setting.
Legal entities, including companies, organisations, associations, etc., as well as individuals under the age of 18, are not eligible to participate in the Scheme.
The Scheme will continue indefinitely until it is revoked (hereafter referred to as the “Duration”).
For the Duration of the Scheme, participants will have the chance to receive a Ferrari gift item (hereafter referred to as the “Gift Item”). The nature and value of this Gift Item will be determined solely at Ferrari’s discretion. Available while stocks last.
To participate in the Scheme, anyone who thinks they have identified a product for sale that may infringe upon Ferrari’s national, international, and European trademarks (hereinafter referred to as “Ferrari Trademarks”) in accordance with applicable laws, can submit a report. This report must include the data specified below, under penalty of rejection, and should be sent using the dedicated form.
Only reports that comply with all the requirements and conditions set out in paragraphs 5.2., 5.3 and 5.4. below will be considered eligible for the Scheme (hereinafter, “Eligible Reports”).
Reports must pertain to potential infringements of Ferrari Trademarks rights, in accordance with the laws applicable in the territories where the infringement occurs.
The report must contain the following information:
Or, in any case, any information suitable to ascertain the reported infringement correctly and unambiguously.
To be considered Eligible Reports, reports must pertain to infringements that Ferrari is not yet aware of. In instances where multiple participants report the same infringement at different times throughout the Duration of the Scheme, Ferrari will only consider Eligible Reports those that were submitted first in chronological order.
Ferrari will not be bound by the terms and conditions outlined in these Rules in case of reports of infringements committed solely for the purpose of acquiring the Gift Item.
Ferrari reserves the right to conduct thorough investigations to confirm the truthfulness and consistency of the reports. These checks may, among other methods, be conducted through inspections of the sites where the reported activities take place. Upon completion of the checks, Ferrari will decide, at its sole discretion and without any obligation to provide justification, whether the report qualifies as an Eligible Report for the purpose of receiving the Gift Item. If, by way of example, the report fails to meet one or more of the criteria outlined in sections 5.2., 5.3. and 5.4, above, it will be deemed as ineligible (hereafter referred to as an “Ineligible Report”).
Participants who have submitted an Eligible Report will receive a message at the email address provided during the report submission (hereafter referred to as the “Communication”). This message will contain instructions on how to obtain the Gift Item. If the Communication is not received within a 60-day period, the report will be deemed as an Ineligible Report, and as a result, the participant will not be eligible to receive the Gift Item.
The Communication mentioned in point 6 will include instructions on how to request the dispatch of the Gift Item. Participants who receive the Communication are required to complete the relevant form, informing Ferrari of the address where they would like to receive the Gift Item. After completing the delivery form, Ferrari will ship the Gift Item to the address provided at Ferrari’s own expense (subject to the availability of the Gifts Items). Ferrari will not be held accountable for any delays or non-receipt of the Gift Item once it has been delivered to the designated carrier. Furthermore, Ferrari will not respond to any inquiries regarding the status or success of shipments.
Participants who receive the Communication must provide the necessary information for the proper receipt of the Gift Item within 10 days of receiving the Communication; failure to comply within the 10 days term will result in forfeiture.
Ferrari retains the right to modify the terms and conditions of these Rules at any given time. If any provision of these terms is deemed invalid, void, or unenforceable for any reason, it will not impact the validity and effectiveness of the remaining provisions.
Statutory guarantees apply in the case of any defects in the Gift Items.
Ferrari takes no responsibility if, upon requesting the Gift Item, the latter has been altered, changed or updated in form and/or substance compared to what was initially promised, or if there is no longer any availability.
These Rules are governed by Italian law.
By submitting your report using the relevant form, you acknowledge and agree to all the terms and conditions outlined in the Rules and the Ferrari Privacy Policy. In such case, you will need to include the following information in your form:
We would like to remind you that the report will only be taken into consideration if you have identified a product that infringes on Ferrari Trademarks being sold at a commercial establishment.
Any information, document, text, or photo that does not pertain to the objectives of the “Ferrari Anti-counterfeiting Reward” Scheme, as outlined in these Rules, will not be taken into consideration by Ferrari in any way.
